These Terms of Service govern your use of the website located at baliaricparasol.com and any purchase made through it. By accessing this website or placing an order, you agree to be bound by these terms. Please read them carefully before purchasing.

We fulfil orders from warehouses located in Canada, Spain, and Bali, Indonesia, depending on the destination. Our fulfilment locations are operational hubs — the business is incorporated and governed under Canadian law.

2. Products

All parasols sold by Baliaric Parasol are 100% handcrafted by skilled artisans in Bali, Indonesia. Each item is unique and made in limited quantities. Slight variations in colour, texture, or pattern are inherent to the handcrafted process and reflect the authenticity of the work — they do not constitute defects.

Product images are representative. Due to the hand-painted nature of each piece, the finished item may vary slightly from the image shown. This is a feature of artisanal production, not a flaw.

3. Pricing & Payment

All prices are displayed in the currency shown at checkout. We reserve the right to correct pricing errors prior to dispatch. Payment is processed securely at checkout via our payment providers. We do not store payment card data.

4. Orders & Contract Formation

Placing an order constitutes an offer to purchase. A binding contract is formed when we send you an order confirmation by email. We reserve the right to decline or cancel any order prior to dispatch, in which case a full refund will be issued.

Some items are available from stock; others are produced to order. Lead times for pre-order items will be communicated at the time of purchase.

5. Shipping & Delivery

We ship globally from warehouses in Canada, Spain, and Bali. Delivery timelines, shipping costs, and customs responsibilities by region are detailed in our Shipping & Delivery Policy, which forms part of these Terms. Risk of loss passes to the customer upon handover to the carrier.

6. Customs & Import Duties

Import duties, taxes, and customs fees applicable in the destination country are the sole responsibility of the recipient. These are government-imposed charges that cannot be included in the purchase price. Estimates by region are available in our Shipping Policy.

7. Returns & Refunds

Our Returns & Refunds Policy is set out in full in a separate document available on this website and forms part of these Terms.

8. Quality Guarantee

Every Baliaric parasol undergoes two independent quality control inspections before dispatch — one at the Bali workshop and one prior to shipment. We stand behind the integrity of every piece we send.

In the event that a parasol arrives damaged or with a manufacturing defect, customers must contact us at info@baliaric.ca within 48 hours of delivery with photographic evidence. We will review each case individually and proceed accordingly.

9. Intellectual Property

All content on baliaricparasol.com — including photographs, text, product names, logo, and design — is the intellectual property of Baliaric Parasol or its licensors. You may not reproduce, distribute, or use any content without prior written permission. The name “Baliaric” and all associated branding are proprietary.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Baliaric Parasol’s liability for any claim arising from a purchase is limited to the value of the order in question. We are not liable for indirect, consequential, or incidental damages. Nothing in these Terms limits liability for death or personal injury caused by negligence, or any liability that cannot be excluded by law.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from a purchase made through baliaricparasol.com shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada, without prejudice to any mandatory consumer protection rights applicable in the customer’s country of residence.

12. Changes to These Terms

We reserve the right to update these Terms at any time. The version in force at the time of your purchase applies to that transaction. Material changes will be communicated via email or website notice.
